WASHINGTON (AP) – Owners of the iPhone will be able to legally unlock their devices so they can run software applications that haven’t been approved by Apple Inc., according to new government rules announced Monday.

The decision to allow the practice commonly known as “jailbreaking” is one of a handful of new exemptions from a 1998 federal law that prohibits people from bypassing technical measures that companies put on their products to prevent unauthorized use of copyright-protected material. The Library of Congress, which oversees the Copyright Office, reviews and authorizes exemptions every three years to ensure that the law does not prevent certain non-infringing uses of copyright-protected works.

For iPhone jailbreakers, the new rules effectively legitimize a practice that has been operating in a legal gray area by exempting it from liability. Apple claims that jailbreaking is an unauthorized modification of its software.

Mario Ciabarra, founder of Rock Your Phone, which calls itself an “independent iPhone application store,” said the rules mark the first step toward opening the iPhone app market to competition and removing the “handcuffs” that Apple imposes on developers that want to reach users of the wildly popular device.

Unless users unlock their handsets, they can only download apps from Apple’s iTunes store. Software developers must get such apps pre-approved by Apple, which sometimes demands changes or rejects programs for what developers say are vague reasons.

Ciabarra noted that Google Inc. has taken a different approach with its Android operating system, which is emerging as the biggest competitor to the iPhone. Google allows users of Android phones to download applications from outside the Android Market.

Although Apple has never prosecuted anyone for jailbreaking, it does use software upgrades to disable jailbroken phones, and the new government rules won’t put a stop to that. That means owners of such phones might not be able to take advantage of software improvements, and they still run the risk of voiding their warranty.

Apple spokesman Natalie Kerris said Monday that the company is concerned about jailbreaking because the practice can make an iPhone unstable and unreliable.

“Apple’s goal has always been to ensure that our customers have a great experience with their iPhone, and we know that jailbreaking can severely degrade the experience,” she said.

In addition to jailbreaking, other exemptions announced Monday would:

- allow owners of used cell phones to break access controls on their phones in order to switch wireless carriers.

- allow people to break technical protections on video games to investigate or correct security flaws.

- allow college professors, film students, documentary filmmakers and producers of noncommercial videos to break copy-protection measures on DVDs so they can embed clips for educational purposes, criticism or commentary.

- allow computer owners to bypass the need for external security devices called dongles if the dongle no longer works and cannot be replaced.

- allow blind people to break locks on electronic books so that they can use them with read-aloud software and similar aides.

Although the jailbreaking exemption is new, all the others are similar to the last set of exemptions, which were announced in November 2006. The new rules take effect Tuesday and are expected to last a few years.

The exceptions are a big victory for the Electronic Frontier Foundation, which had urged the Library of Congress to legalize several of them, including the two regarding cell phones.

Jennifer Stisa Granick, EFF’s civil liberties director, said the rules are based on an important principle: Consumers should be allowed to use and modify the devices that they purchase the way they want. “If you bought it, you own it,” she said.

SEOUL, July 23 (via: Reuters) – LG Display may cut production of its liquid crystal displays (LCD) next month due to weak demand from TV makers but is unable to meet strong demand tied to Apple’s iPad tablet computer, its chief executive said.

“We are now running at full capacity but we are considering production cuts in August,” LG Display CEO Kwon Young-soo told reporters. “The level of reduction will be smaller than the industry average.”

The effect of southern Europe’s debt crises is the only major concern for LG Display but Kwon said overall demand for LCD may pick up along with flat panel prices from September. LG Display reported Thursday its second-quarter operating profit more than doubled to 726 billion won ($603.5 million).

“We expect the market to improve from September and prices to stabilise,” Kwon said.

The company is a supplier to Apple’s iPad, which has sold 3.47 million units since its April launch, and Kwon said LG Display was unable to meet growing demand from Apple.

“Demand (from Apple) keeps growing and we can’t meet it all. Apple may have to delay launches of the iPad for some countries due to tight component supplies and strong demand.

“We are considering increasing production lines for iPad products but overall supply is likely to remain tight until early next year.”

Apple said this week it planned to start selling the iPad in nine new international markets on Friday, making the device available in a total of 19 countries.

Analysts expect iPad demand to accelerate in the coming quarters. Research firm iSuppli raised this week its forecast for iPad sales by 82 percent to nearly 13 million units this year.

LG Display, which plans 5.5 trillion won in investment this year, announced on Thursday a 618 billion won investment plan to boost production capacity for small-sized flat screens used in mobile phones and tablet PCs.

Kwon’s comments were made late on Thursday and embargoed until Friday morning.

Apple put out a statement on Friday that the mythical unicorn white iPhone 4 will be delayed until later this year.

The company said:

White models of Apple’s new iPhone 4 have continued to be more challenging to manufacture than we originally expected, and as a result they will not be available until later this year. The availability of the more popular iPhone 4 black models is not affected.

It is unclear if the delay is due to high demand of the device or because of the problems with the white paint formula. There are some indications that the glass supplier ran into issues with the thickness and opacity of the paint when applied to the glass. Either way those holding up for the white iPhone will have to wait a little longer.

Here comes Apple’s new idea for allowing a user to log into future iPhones using biometric sensors. The patent app for the feature sensors in the iPhone case that would read the users heart rhythm when they pick up the phone.

This is an electronic device having a seamlessly integrated cardiac sensor. The cardiac sensor can be integrated in any suitable portion of the electronic device, including for example a portion with which the user is typically in contact (e.g., an input mechanism or a housing held by the user), or metallic or conductive portions of the device.

US20100113950

These heart readings can be used to identify the user and allow them access to the iPhone if approved. There is little info on exactly how the user would be identified, but this is a cool idea assuming it works, unless you’re having a heart attack and try to call for help.

Associated Press, Bloomberg News, the Los Angeles Times, and Wired.com have prepared a 7-page legal brief that will ask a court to unseal the detective’s affidavit used to obtain a search warrant nearly two weeks ago. A hearing has been tentatively scheduled in the San Mateo County courthouse for 2 p.m. PDT on Thursday. It turns out that the court sealed the records for the 4G iPhone case and the reason it ordered the search warrant to ransack the home of Gizmodo editor Jason Chen.

The judge sealed the files without the proper hearing. By law in order to seal the documents, a hearing is required to provide sufficient reason to do so otherwise they should remain open to the public.

“The search warrant records at issue here are judicial records to which the press and public have a constitutional right of access, and the order sealing these records did not–and could not–comply with the procedural and substantive requirements for sealing. The sealing order is therefore invalid and unconstitutional and should be vacated.” (The California Newspaper Publishers Association and the California-based First Amendment Coalition joined the brief too.)

It seems that Apple Inc has the power to sway judges to break the law and the constitution to do what they want. What the hell is wrong with this picture? Are we living in the 1920′s where the mob did things like this? This story stinks to high heaven.

On Monday, Apple announced that it sold 1 million of its popular iPad in just 28 days. This is twice as fast as Apple sold the iPhone when it launched. Although expensive the demand for iPads exceeds the supply. All these computing experts are trying to make sense of what is going on. Frankly they have no clue because they are looking at the market through a straw and not looking at what the people want.

Luckily Apple did and they are delivering it. The majority of people are consumers of media and technology, not creators. All the big PC makers are stuck on delivering faster and smarter computers to people who don’t need that. Average Joe and Jane use their supped up rigs and laptops for just a few basic things, such as E-Mail, reading news, listening to music, watching movies, storing personal photos, checking Twitter, Facebook and occasionally blogging. All this can be done with an iPad seating on your couch or in bed. Consumers want to be comfortable while consuming media, and the iPad delivers. Now you don’t have to go to your desk to read the news or hold a heavy, hot lump of plastic in your lap while trying to navigate the touch-pad. To put it in really lame terms, people want to take a dump with media in their hands while smoking a fatty.

Yes, traditional computers are useful for a few who play games and create content, but trying to sell them to the rest of the people is like trying to sell a space rocket to somebody that just needs and wants a motorcycle. This is why iPad type devices are the future, and until the rest of the industry realizes this Apple will rule the market.

Soon after The federal Trade Commission poked its nose into Apple’s practices it looks like a revision to the Developer Agreement is in the works. More and more Apple appears to use means that got Microsoft in hot water during the 90′s. Besides the flash fiasco with Adobe, The FTC is taking an interest to the iAd mobile-advertising service also. The language in the Developer Agreement forbid developers to send analytical data to advertisers from their apps. This hinders advertising networks such as AdMob and Millenial Media to properly target the mobile users, thus giving an unfair advantage to Apple’s iAd.

Mobile advertising it’s a much more exact science than conventional web advertising, generating much more user response. Google’s acquisition of AdMob and Apple’s iAd are in fact bumping heads for the control of the iPhone and iPad market. Their relentless war against eachother does nothing but hinder progress and competition in this market. The victims here are the developers who are constrained to ad revenues and the advertisers who will get a less than optimal ad campaigns, just because the market owners are quarreling for control.
